Welcome to Nexvi! These Terms of Service (“Terms”) govern your use of our website [www.getnexvi.com], software, products, and services (“Services”) provided by Nexvi (“we”, “us”, or “our”). By signing up for our Services or using our platform, you agree to these Terms.

If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old and operate a legitimate business to use our Services. By using Nexvi, you confirm that you have the authority to bind your business to these Terms.

2. Services Provided

Nexvi offers:

Review automation via email and SMS

Missed call text-back automation

Monthly performance reporting

Smart review routing links

SMS number provisioning and 10DLC compliance support

We handle the setup and management of these services on your behalf under a managed plan.

3. Subscription and Billing

A $99 one-time setup fee is required to activate your account and complete onboarding.

After onboarding, you will be billed $297/month for the Nexvi Pro subscription.

Your plan includes up to 500 texts and 2,000 emails per month. Additional usage will incur extra charges.

All payments are non-refundable once billed.

You can cancel your subscription anytime before your next billing cycle.

4. Client Data and Responsibilities

You are responsible for:

Submitting accurate client contact information for review requests

Ensuring you have consent to contact your customers via SMS and email

Complying with any local or industry regulations (such as TCPA or CAN-SPAM)

Nexvi is not liable for misuse of contact information or customer communications outside the intended use of our platform.

5. Review Generation

We do not guarantee that your customers will leave reviews. Nexvi facilitates review collection, but the final action is up to your clients. Results vary by business type, industry, and customer engagement.

6. Messaging Compliance

We register your business with major SMS carriers for 10DLC compliance using the information you provide. If this info is incorrect or incomplete, your registration may be delayed or rejected.

All messaging services are subject to carrier approval and restrictions.

7. Account Termination

We may suspend or terminate your account if:

You violate these Terms

You use the platform for illegal, harmful, or deceptive practices

Payment fails repeatedly or goes unresolved

Upon cancellation or termination, we may assist with transferring your dedicated number and customer data if requested.

8. Intellectual Property

All content, branding, and software related to Nexvi are the property of Nexvi and may not be copied, altered, or reused without written permission.

9. Limitation of Liability

Nexvi is not liable for:

Loss of business or revenue due to missed reviews or messaging issues

SMS or email delivery failures due to carrier or email provider disruptions

Delays or issues caused by incomplete onboarding information

Our maximum liability under these Terms is limited to one month of your subscription fee.

10. Changes to Terms

We reserve the right to update these Terms. If changes are material, we will notify you via email or within your account. Continued use of the Services constitutes acceptance of the new Terms.
